International arbitration operates within a private law paradigm, yet regularly adjudicates conflicts between private and public interests, especially in the context of energy and natural resources disputes.
The public-private divide brings into tension arbitral efficiency and neutrality on the one hand, and concerns over transparency and legitimacy of the process on the other hand. It also raises questions as to the proper legal and analytical framework for adjudicating public-private disputes. There have been proposals to "repoliticize" dispute resolution, promote arbitrator interventionism and embed the adjudication of public-private disputes into a public law narrative.
