Document production can often become a burdensome, costly, and ineffective exercise.

In response, a working group of the ASA User Council (comprising in-house counsel from several major companies) has taken the initiative to call for a robust readjustment of current procedures and to make concrete recommendations aimed at keeping arbitration efficient and attractive.

The working group released a whitepaper on document production in September 2025, proposing measures that parties, counsel, arbitral tribunals, and institutions can apply both before a dispute arises and once an arbitration is underway.

The panel will discuss the proposed measures and share their own experiences with the document production process.
