Presentation

England and Wales is shortly due to amend its arbitration act following the Law Commission's extensive review, introducing reforms impacting award challenges. Meanwhile, France is contemplating its own reform, aiming to modernise and refine its arbitration regime, while still relying on case law to provide much-needed clarifications and answers as to the interpretation of the current regime.

This panel will analyse the key changes introduced in England & Wales, their effect on the court's review of awards, and the extent to which they align with or diverge from French practice. We will also discuss the anticipated French reform, its objectives, and its potential influence (if any) on the dense and ever-evolving case law of setting-aside and enforcement of awards proceedings.

The panel will also look at recent case law developments in relation to challenging awards and what lessons can be drawn from these cases.
