In arbitration, the selection of the expert is often seen by the parties as an essential factor for success in enlightening the tribunal as to what is at stake in the dispute.
Traditionally, experts were chosen based on qualifications, experience, and peer recognition, not forgetting reputation, and recommendations.
While artificial intelligence plays an increasingly significant role in decision-making, the process of selecting experts is in constant evolution.
The rise of AI-driven nomination tools is now influencing this process, using algorithms to assess the domain of expertise and suggest candidates.
This raises important questions: Are AI-driven nominations truly fair? Do they introduce biases and limitations? Can AI enhance objectivity and efficiency? On what data are suggestions based?
Are there ways of ensuring that algorithms don't undermine efforts to achieve greater diversity?
In search of equitable and credible selection process, the panel will provide a variety of insights to try to answer this question : Can AI-driven nominations truly ensure fair and impartial expert selection in arbitration and dispute resolution?
