In what ways and to what extent is international arbitration law currently pushing the envelope? The expert panel will focus on some examples of recent radical developments in international arbitration. In particular, the panel will address the extent to which the Singapore Court of Appeal decision in Anupam Mittal v Westbridge Ventures II Investment Holdings has given rise to debate regarding the governing law of arbitrability in India and England (specifically whether arbitrability is decided under the substantive law of the contract or the agreement to arbitrate or the law of the seat, and whether that question is affected by the stage at which the question is raised). The panellists will also cover the extent to which the envelope is being pushed outwards in the context of cross-border recognition and enforcement of awards, including in respect of award laundering and the re-litigation of issues already determined at the seat court.
Registration will start at 1.30pm. The panel will commence at 2pm, followed by a champagne and canapes reception from 3.30pm.
