Artificial intelligence is rapidly reshaping international arbitration, but its impact may be most profound where legal systems, regulatory approaches, and professional cultures intersect. In the Middle East and North Africa region, arbitration continues to grow in sophistication and complexity. At the same time, AI tools are increasingly embedded in legal strategy, document analysis, and expert economic modelling.
This panel examines AI as arbitration’s “invisible co-counsel”: a force that not only assists practitioners, but subtly shapes case theory, procedural tactics, and evidentiary methodology. Are AI tools reinforcing dominant reasoning patterns derived from past awards? Do they risk creating strategic asymmetries between parties with unequal technological access? Could reliance on AI in damages modelling introduce opacity into proceedings seated in jurisdictions where due process scrutiny is evolving?
Bringing together a diverse group of arbitration practitioners, the discussion will explore whether AI is becoming a competitive necessity, and whether, in the near future, failing to use it may fall below the professional standard of care.
