Transatlantic Views on Med-Arb/Arb-Med: convergency or chasm?

This panel of speakers, drawn from the US, Netherlands and France will consider current best practices and approaches to the use of mediation in combination with arbitration, or what is often referred to as Med-Arb/Arb-Med. Historically, the civil law tradition has been more receptive to the Med-Arb/Arb-Med concept, whereas the common law world has approached the issue with reticence. In recent times, however, some have suggested that there is a growing consensus on this issue, and that it is time for transnational guidelines on the implementation of Med-Arb / Arb-Med to be developed and implemented across the field of international arbitration. The panel will consider the current state of play regarding the use of Med-Arb / Arb-Med in international arbitration, and the possibilities for convergence on a truly transnational approach.
