With the rapid growth of cross-border trade and investment, international arbitration has solidified its role as the preferred mechanism for resolving those disputes. However, the interplay of cultural nuances and legal traditions—particularly between civil law and common law jurisdictions—raises significant questions about fairness and stakeholder trust.

Cultural differences, such as those traditionally associated with Asian jurisdictions—values like deference, hierarchy, and non-confrontational communication—may contrast with approaches that prioritize directness, individualism, and procedural transparency. These differences may play a role throughout proceedings, from business dealings, negotiations tactics and decisions to commence arbitration, selection of arbitrators, to procedural and hearing stages, and ultimately to the interpretation and perception of justice.
