The approach to quantifying a claim can make or break a dispute. Identifying the correct approach is, therefore, a critical issue for legal practitioners. A substantial proportion of international arbitrations involve emerging or less developed economies. Such economies often operate in a volatile political and social landscape, frequently with insufficiently liquid capital markets, and fragile financial and regulatory institutions.
How do these realities influence the assessment of damages and are they properly accounted for?
Do they contribute to the perception (or reality) that developing countries are disproportionately hit by outsized damages claims?
Can these factors create more roadblocks for claimants trying to establish their entitlement to damages?
Our panel comprises arbitration practitioners from France, UK and Kenya, a former senior executive of a large corporate, as well as quantum experts. All our panellists have significant experience in handling disputes in developing economies. Their combined experience will provide a comprehensive insight into how to deal with the challenges which exist in these markets. Whilst this event will address some technical issues, it is primarily aimed at senior legal practitioners who represent clients operating in developing economies. The session will provide useful takeaway points on how to shape the issue of damages assessment in a potential or ongoing dispute.
