As enforcement of arbitral awards increasingly involves assets (or information about assets) held by international organisations such as Euroclear, Clearstream, Eurocontrol, IATA, the EU, SWIFT or ESA, difficult questions arise as to whether these assets are truly “untouchable”.
This panel will examine how sanctions regimes, immunities and regulatory frameworks interact with enforcement efforts, and how courts are navigating these competing considerations in practice
