Les personnes publiques dans l'arbitrage : aspects d'arbitrage commercial et d'arbitrage d'investissement

Le Rapport du groupe de travail sur la réforme du droit français de l’arbitrage propose de consacrer le principe d’arbitrabilité des litiges internationaux des personnes publiques françaises et de concentrer le contrôle des sentences au stade de l’annulation ou de l’exequatur entre les mains du juge judiciaire. Ces propositions mettraient fin au principe séculaire d’interdiction faite aux personnes publiques de recourir à l’arbitrage ainsi qu’à la jurisprudence INSERM du Tribunal des conflits consacrant la compétence du juge administratif en matière de sentences internationales. Sont-elles souhaitables ou est-ce qu’une autre voie est possible ?

De même, si le projet de réforme est muet sur l’arbitrage d’investissement, et malgré les contraintes imposées par le droit de l’Union il n’en demeure pas moins que l’actualité est nourrie de nombreuses sentences ou décisions juridictionnelles étatiques en la matière (sanctions contre la Russie, consentement…).

The report of the working group on the reform of French arbitration law proposes to enshrine the principle of the arbitrability of international disputes involving French public entities and to concentrate the control of awards at the stage of annulment or enforcement in the hands of the judicial judge. These proposals would put an end to the historical principle prohibiting public entities from resorting to arbitration, as well as to the INSERM case law of the Tribunal des conflits establishing the jurisdiction of the administrative court in matters of international awards. Are they desirable, or is another path possible?

Similarly, although the reform bill makes no mention of investment arbitration, and despite the constraints imposed by EU law, the fact remains that many awards and decisions by state courts on this subject are in the news (sanctions against Russia, consent, etc.).
