Insurance and enforceability of dispute resolution clauses

French Supreme Court gradually amends its case law on third-party claims based on breach of contract. By recently ruling that prior conciliation clauses are enforceable against third parties, it has revived the debate concerning the enforceability of dispute resolution clauses in insurance relationships, particularly with regard to direct action.
