Objective: Examine recent divergences between French and Italian courts on critical enforcement and annulment issues.

The session will compare judicial approaches to partially set-aside awards (including Italy’s denial of recognition of awards in their entirety versus France’s willingness to enforce severable portions), suspension of enforcement pending set-aside proceedings, the scope of public policy defenses, and challenges based on arbitrator impartiality and independence.

Through analysis of recent case law from the Paris Court of Appeal and the Italian Supreme Court, practitioners will gain practical insights for navigating enforcement strategy across these two essential European jurisdictions.
