The Investor-State Dispute Settlement (ISDS) system is facing a new set of challenges in the era of geopolitical conflicts. States that once focused on protecting outbound investments are now finding themselves in the role of respondents in arbitration. Meanwhile, critical questions of public international law are increasingly at the heart of these disputes.
