Presentation

This panel will present the geopolitical, commercial and legal impact of the series of cases against Gazprom Export and Venture Global, in particular how they affect the European energy outlook and their significance for gas arbitration.

In recent years, the number of gas arbitrations increased significantly. While many cases are trade disputes, two series of disputes relating to long-term supply arbitrations started in the wake of the Ukraine war. These arbitrations involve 2 respondents only: Gazprom Export in Europe and Venture Global in the US. Some were concluded and many are pending. The earliest cases were filed in late 2022 and the most recent ones in 2024.

These arbitrations are at the core of energy supply to Europe, and relate to gas production from two of the main global producers: Russia and the US. They affect energy security and the stability of the European economies.

The panel will discuss the fundamental geopolitical issues the cases pose to the EU, and to the global energy markets. It will also cover commercial and legal issues, including in relation to dispute resolution.

The panel will also discuss whether these disputes are tied to unique circumstances or if they herald a new era of gas disputes.
