Presentation

At the time when investor-State dispute settlement is being called into question, the panel discussion will focus on valuable lessons that may be learned from the WTO and CAS dispute settlement mechanisms, including the approach to case management, the interpretation of substantive protections, prospective non-pecuniary relief and the possibility of appeal. The discussion will contribute to the debate on the scope of the proposed reforms of the ISDS mechanism and whether certain proposals withstand scrutiny when considered against the application of similar mechanisms before the WTO and the CAS.
