James HERBERT
James Herbert is a Partner-elect at Gaillard Banifatemi Shelbaya Disputes.
Enrolled as a Barrister and Solicitor in New Zealand, James has been involved in more than 75 major international arbitrations, including State-State, investor-State and commercial international arbitrations under the ICSID, ICC, SIAC, HKIAC, LCIA, UNCITRAL, SCC, CRCICA, CAS and NAI Rules (as well as ad hoc arbitrations). He has handled a wide variety of disputes concerning inter alia post M&A claims, shareholder disputes, civil fraud, bribery and corruption, energy regulation, competition and public procurement, international sale of goods, taxation, agency and assignment law issues. His experience spans a broad range of sectors including energy (oil and gas, electricity and renewables), pharmaceuticals, mining, commodities, private equity, finance, shipping, aviation, defence, insurance, telecommunications and sports.
James previously was a member of Shearman & Sterling’s international arbitration team, where he practiced for eight years. Prior to that, he practiced as the principal assistant of one of the world’s foremost arbitrators for four years.
