Presentation

Economic sanctions in arbitration are not new. For
a long time, arbitral proceedings and enforcement
or annulment proceedings have had to deal with
multilateral sanctions imposed by the United
Nations Security Council or unilateral sanctions
imposed by, for example, the United States.

However, the severity of the restrictive measures
against Russia in relation to Ukraine, adopted by
the European Union in coordination with other G7
countries, has opened the door to a significant
increase in sanctions-related arbitrations. This has
raised a number of issues, such as the
enforceability of the arbitration clause when it is
challenged in the Russian courts; the constitution
of arbitral tribunals when licenses allowing
arbitrators to receive payments from sanctioned
parties are not issued; the merits of the case when
the performance of the contract has become
illegal; or the enforcement of awards when they
have been rendered against a sanctioned party is
not guaranteed in all jurisdictions.

Organized under the aegis of the Sorbonne Law
School and ICC France, this round table will bring
together renowned arbitration experts and
practitioners to provide answers and reflections on
these highly topical issues.
