Lost profits exceed wasted costs when the rate of return of an investment exceeds the applicable discount rate.
This implicit assumption is too often taken for granted and not demonstrated. However, as experts, it is our role to justify and explain the rationale behind it so Tribunals can feel confident in awarding damages on this basis.
During this workshop we will explore efficient ways to build a robust claim for lost profits, requiring collaboration between a client, counsel and the expert.
