Dispositive motions, common practice in the United States, are gaining traction in the wider international arbitration community, making their way into several different global institutional rules. They are, however, less commonly used in civil law jurisdictions.
Summary or dispositive proceedings are often promoted as tools to accelerate the resolution of a claim, promote efficiency, and conserve judicial resources. Despite these goals, do they live up to their extolled virtues in practice?
