Provisional Measures in International Arbitration: Strategic Lessons from Recent Practice

Provisional measures can be instrumental in the settlement of international disputes. Yet, this highly relevant topic receives relatively little attention in the literature. Exchanges amongst practitioners are therefore a primary means to take stock, debrief and discuss the panoply of tools at the disposal of counsels, arbitrators and arbitral institutions.
The aim of this event is just that: a forum for a discussion amongst practitioners with experience in international commercial and investment treaty arbitration. Panellists will discuss the various strategic tools that arbitrating parties can resort to in the context of provisional measures (or emergency arbitrator) requests (e.g., offers or requests for cross-security, requests for TROs, etc.) as well as potential hurdles and strategies to avoid them.
