Pierre TERCIER
Professor Pierre Tercier is an Emeritus Professor of the University of Fribourg, the Honorary Chairman of the ICC International Court of Arbitration and an international arbitrator with extensive international arbitration and dispute resolution experience. He has served, mainly as president, in around two hundreds international arbitrations under various rules (i.e., ICC, ICSID, LCIA, SIAC, CRCICA, SCC, UNCITRAL etc.) covering various sectors. He is respected in the international legal and business community as an arbitrator, lecturer and author.
He graduated from the University of Fribourg summa cum laude and was admitted to the bar in 1969. He was awarded an Honorary Doctorate by the University of Paris II Panthéon-Assas in 2004 and in 2023 by the University of Neuchâtel. He spent the first part of his career as a teacher at the Law Faculty of the University of Fribourg, where he taught, among others, contract, torts, commercial law, competition law and arbitration. He published and edited numerous books and articles that still represent classical sources of Swiss Law. He has been a visiting professor at numerous universities around the world, including in Geneva (LL.M. in International Dispute Settlement (MIDS)), Paris (Panthéon-Assas), Turin and Washington DC (Georgetown). He is a former chairman of the Swiss Competition Commission and of the Swiss Insurance Law Society. He was a member of the Comité de Banque of the Banque Cantonale de Fribourg for 11 years.
Already early in his career, he started receiving arbitral appointments. Later, he became the President of the International Court of Arbitration of the ICC. He is a member of the Advisory Board of the International Council for Commercial Arbitration (ICCA) and was a member of the Comity of the Association of Swiss Arbitration (ASA). A few years ago, he joined Peter & Kim in Geneva as Senior Counsel. Cases in the banking sector in which Prof. Pierre Tercier acted as president include:
- X. vs Bank Y (ad hoc procedure) exit of a partner of a private bank;
- Abaclat and others vs Argentine Republic (ICSID). Mass claim litigation;
- Two ICC Cases.
