Presentation

Behind a common consensus that international arbitration should fully contribute to the fight against corruption, there still remain conflicting approaches as to what corruption precisely encompasses and as to what should be the respective roles of arbitral tribunals and enforcement/annulment judges in that fight. The discussion will cover the treatment of corruption allegations in both commercial arbitration and investment treaty arbitration. It will also cover recent case law from various jurisdictions such as France and UK to show the contrasting approaches to what is considered to be the proper degree of control of the annulment judges over corruption allegations.
