Presentation

Financial services institutions have traditionally preferred litigation over arbitration as their forum of choice for dispute resolution. However, since the mid-2000s, there has been a significant rise in the number of finance disputes resolved through international commercial arbitration, covering a broad range of financial products, services, and contracts.

At the same time, investment arbitration has also seen an increase in cases where financial products have been assessed as forms of investment protected under international investment law. This includes public economic instruments such as the issuance of government bonds, as well as bail-in/bail-out mechanisms and debt restructuring.

Against this backdrop of evolving practices, experts in arbitration and financial law will analyze some of the most prominent and recent cases, addressing key issues and trends that can provide valuable insights into the future of this increasingly important sector for arbitration.
