However, since the mid-2000s, there has been a significant rise in the number of finance disputes resolved through international commercial arbitration, covering a broad range of financial products, services, and contracts.
At the same time, investment arbitration has also seen an increase in cases where financial products have been assessed as forms of investment protected under international investment law. This includes public economic instruments such as the issuance of government bonds, as well as bail-in/bail-out mechanisms and debt restructuring.
