New-Generation BITs: Reform, Rebrand, or Reset? is a PAW session examining how “new generation” bilateral investment treaties are evolving—and whether recent changes amount to genuine reform, a rebranding exercise, or a full reset of the investment protection model.

Bringing together perspectives from States, investors, arbitrators, and counsel, the discussion will unpack key treaty innovations (including sustainability/ESG language, refined substantive protections, transparency, and dispute settlement redesign).

It will also explore whether these new-generation BITs are changing how stakeholders understand and apply key legal standards, and whether that shift is already visible in the reasoning and outcomes of recent cases.
